H. PARTIAL NULLITY
If any of the parties does not execute any of their rights under this contract, it will not be considered as a waiver of said right unless it is expressly communicated in writing.
Although some of the parties to this contract are not considered legal or valid by a judicial body, the rest of the contract will continue to apply.
I. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for any breach or delay in the fulfillment of any of the obligations that we assume under a Contract, the cause of which is due to events that are beyond our reasonable control (“Force Majeure”). The Causes of Force Majeure will include any act, event, lack of exercise, omission or accident that is beyond our reasonable control and among others, the following:
1. Strikes, lockouts or other protest measures.
2. Civil commotion, revolt, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparations for war.
3. Fire, explosion, storm, flood, earthquake, sinking, epidemic, or any other natural disaster.
4. Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.
5. Impossibility of using public or private telecommunications systems.
6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.
7. Strike, failures or accidents of maritime or river transport, postal or any other type of transport.
It will be understood that our obligations derived from the Contracts will be suspended during the period in which the Force Majeure Event continues, and we will have an extension in the term to fulfill said obligations for a period of time equal to the duration of the Force Majeure Event. We will use all reasonable means to end the Force Majeure Event or to find a solution that allows us to fulfill our obligations under the Contract despite the Force Majeure Event.
J. JUDICIAL COMPETENCE AND DETERMINATION OF COMPETENT FORUMS
CONFIANZA ONLINE and in the terms of its Code of Ethics, in the event of controversies related to online contracting and advertising, data protection, protection of minors and accessibility, the user may resort to the system of out-of-court dispute resolution of CONFIANZA ONLINE.
M. GENERAL INFORMATION ABOUT WARRANTIES
In the event of a defective product Fuerteventurabikeshop © must proceed, as appropriate, to repair, replace, lower the price or terminate the contract. These steps will be free for the consumer and user.
Fuerteventurabikeshop © is responsible for any lack of conformity that appears within a period of two years from delivery. The consumer and the user must inform Fuerteventurabikeshop © of the lack of conformity within 15 days of their purchase.
Fuerteventurabikeshop © will provide post-sale assistance to the consumer and user as well as after-sales service and commercial guarantees, as well as their conditions.
